Supreme Court has declared unconstitutional the appointment of seven non-MP ministers

Kathmandu, June 20: The Supreme Court has declared unconstitutional the appointment of seven non-MP ministers for the second time. A single bench of Chief Justice Cholendra Shamsher Jabra, while hearing the writ petition against his second appointment, quashed his re-appointment through an interim order.

Seven former Maoist ministers have been automatically relieved of their posts following an interim court order. Former UCPN-M’s Ram Bahadur Thapa Badal, Top Bahadur Rayamajhi, Lekhraj Bhatt, Prabhu Sah, Gauri Shankar Chaudhary, Mani Thapa and Dawa Lama are not MPs. Badal was the Home Minister while Rayamajhi was the Energy Minister.

A bench of Chief Justice Rana has ruled that a person who is not a member of parliament can be a minister only once for six months and not again. It has been mentioned that if a person becomes a minister for the first time, he / she will be automatically relieved of his / her post even after six months.
